By accessing and using ImageTo3D ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ImageTo3D provides an AI-powered service that converts 2D images into 3D models. The Service uses machine learning technology to generate 3D assets from user-uploaded images.

3. User Accounts

To use certain features of the Service, you must create an account using Google authentication. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

4. User Content and Intellectual Property

Your Content: You retain all rights to the images you upload. By uploading content, you grant us a limited license to process your images solely for the purpose of generating 3D models.

Generated Content: You own the 3D models generated from your images. For paid plans, you receive a commercial license to use the generated models for any purpose, including commercial projects.

Restrictions: You must not upload content that infringes on third-party intellectual property rights, contains illegal material, or violates any applicable laws.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that is harmful, offensive, or infringes on others' rights
• Attempt to interfere with or disrupt the Service
• Use automated systems or bots to access the Service without permission
• Reverse engineer or attempt to extract the source code of the Service

6. Payments and Refunds

Credits: Credits purchased are non-refundable once used. Unused credits may be refunded within 14 days of purchase.

Subscriptions: Subscription fees are billed in advance. You may cancel at any time, and your subscription will remain active until the end of the current billing period.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue the Service at any time with or without notice.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be error-free or that generated models will meet your specific requirements.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMAGETO3D SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

10. Indemnification

You agree to indemnify and hold harmless ImageTo3D and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
